This section limits certain rights, including the right to maintain a court action, the right to a jury trial, the right to participate in any form of class or representative claim, the right to engage in discovery except as provided in the AAA rules, and the right to certain remedies and forms of relief, other rights the parties would have in court may also not be available in arbitration.

No Refunds No Exchanges on Electric Bike, Electric Moto, Electric Surf 

We appreciate your business and interest in our products. We want to ensure positive experiences when visiting our web store and purchasing from our website.  We advise always researching and educating yourself and visit a dealer location to test ride your e-bike/e-moto before making any purchase.  Our staff are knowledgeable and ready to help you understand the functions and safety features of each e-mobility equipment during your test ride experience.  We advise always checking each mechanism (ie brakes, tire pressure, seat post clamps, handlebars, pedals) of your e-bike/e-moto before each ride.  

Certain terms and conditions apply as expected with shopping experiences.  By placing an order and purchasing a product from our website, you agree to the terms detailed below along with other terms on our website, ie warranty, return policies, our privacy policy, and terms of use.  We request that you please review everything fully and carefully so you are informed about your rights and obligations by participating on our website.

Acceptance of Terms. You (“Customer”) may place orders for Products by the various brands we carry: ie ERide Pro, Macfox, Hyper GoGo, Urtopia, and more.  “Product(s)” collectively means any and all items being sold by our brands we represent to you in the United States. By placing an order, you consent to these Terms and Conditions of Sale (“Terms”) and acknowledge that we will furnish the Products subject to these Terms.   Unless expressly agreed to or outlined in writing by E-Motion Sports, any term or condition in any order or other form or correspondence that is in any way inconsistent with these Terms shall be inapplicable and of no force and effect whatsoever.  We recommend customers educate themselves on the safety and correct operation of their electric mobility before completing their purchase.  We strongly encourage visiting your local electric bike store, to test ride and learn the functions of their electric bike, electric moto, electric surf equipment.  Our staff are available to assist you as you request.  

Changes To This Policy

Please note that our Terms & Conditions and our Return Policy may change from time-to-time. We will not reduce your rights under these policies without your explicit consent, and we expect most such changes will be minor. Regardless, we will post any policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of policy changes). Each version of these policies will be identified at the top of the page by its effective date, and we will also keep prior versions of these policies in an archive for your review.

In-Store Pickup
Any orders marked as 'ready' for in-store pickup must be collected within 14 days from the notification date.

Price. All prices on our website are subject to change and exclude applicable tax and shipping. We reserve the right to change pricing at any time or correct pricing errors that may occur. All prices are listed in U.S. Dollars.

Products Available. ALL Product Descriptions on our website is subject to change at any time without notice, at our sole discretion. We reserve the right to change or discontinue a product at any time. We make every effort to accurately portray and display colors and images of the Products as accurately as possible. We cannot guarantee that your device’s display of any color will be accurate and a true reflection of the physical item upon receipt.

Special Offers. From time to time, we may be offering special promotions for some or alr Products, including discounts, limited edition products, or free shipping. These offers may be for a limited time only and E-MOTION SPORTS INC. reserves the right to change or discontinue such offers at any time.

Orders. All orders are subject to E-Motion Sports' (EMS) acceptance. This means EMS may for any or no reason refuse to accept or may cancel or limit any order, or order quantity, whether or not the order has been confirmed.  Please be aware that your receipt of an order confirmation does not mean our acceptance of your order, nor is it a confirmation of our offer to sell.  We are confirming we received your order. Customers will be refunded for an order If we (EMS) cancel an order after you have already been charged.
